Amendment C466 seeks to make minor changes and improvements to the Melbourne Planning Scheme to ensure it is clear, concise and up to date.
The amendment will make minor changes to zone and overlay schedules, maps and an incorporated document. These changes are administrative, improving clarity, fixing errors and removing redundant requirements.
The amendment will not make changes to the intent or directions of existing planning policy.

Land affected by the amendment
The land affected by the amendment is:
- land in the CBD Hoddle Grid and Southbank (all land within Schedules 1, 2, 3 and 7 to the Capital City Zone)
- land in Carlton (all land within Schedule 2 to the Comprehensive Development Zone; all land within Schedules 5 and 6 to the Capital City Zone)
- land in Docklands (all land within Schedules 1, 2, 3, 4, 5, 6 and 7 to the Docklands Zone)
- individual sites in Kensington, Carlton, CBD Hoddle Grid, West Melbourne, Southbank and Parkville (see Key changes below).

The proposed change will specify that a planning permit is required for a ‘minor sports and recreation facility’ in the CCZ5.
This change will formalise Council’s existing approach to considering minor sports and recreation proposals under this zone.
In the Melbourne Planning Scheme, schedules to the Capital City Zone, Docklands Zone and Comprehensive Development Zone include a requirement that some types of minor works must be done to ‘council’s satisfaction’ even though a planning permit is not required. This is often referred to as ‘Town planning satisfaction’ (TPS). A TPS assessment requires the submission of plans, associated documentation and an application fee.
The amendment proposes to remove this requirement for minor works, such as shop front alterations and instalment of building services (e.g., pipes, flues, ducts).
A planning permit may still be required by another planning control such as a Heritage Overlay, in which case a full assessment can be undertaken according to the requirements of that overlay.
In the Melbourne Planning Scheme, schedules to the Capital City Zone, Docklands Zone and Comprehensive Development specify that a planning permit is not required for a ‘window display’. The amendment proposes to delete this permit exemption.
The term ‘window display’ is not a defined term in the planning scheme. It is outdated terminology which is inconsistent with the operation and interpretation of signage provisions in a contemporary Planning Scheme.
This proposed change will rezone this Council-owned land to reflect its public ownership and its intended purpose as future public open space. The proposed zone will support the development and ongoing management of this public open space.
The changes resolve errors and inaccuracies in the description and mapping of several heritage places and one significant tree. The amendment does not introduce new Heritage Overlays or Environmental Significance Overlays; it fixes inaccuracies relating to sites that have previously been listed in the Melbourne Planning Scheme through earlier planning scheme amendments.
Corrections of inaccurate mapping of the Heritage Overlay affect the sites listed below.

Corrections to mapping in Schedule 1 to the Design and Development Overlay
The amendment proposes to correct a map within Schedule 1 to the Design and Development Overlay (DDO1) to ensure that it includes the site at 135-149 Kings Way, Southbank. The site is already affected by the Design and Development Overlay Schedule 1. The proposed change will ensure that the relevant requirements of the schedule are applied in the assessment of any future planning permit application.

- Amend Schedules 1, 2, 3, 6 and 7 to Clause 37.04 Capital City Zone (CCZ1, CCZ2, CCZ3, CCZ6 and CCZ7) by revising and deleting permit exemptions relating to minor works and building entranceways, and improving clarity of permit exemptions for advertising signs.
- Amend Schedule 2 to Clause 37.02 Comprehensive Development Zone (CDZ2), by revising and deleting permit exemptions relating to minor works, shopfront windows and building entranceways, and improving clarity of permit exemptions for advertising signs.
